4-MeO-PCP is unscheduled in the United States. It is possible that it could be considered an analog (of PCP), in which case, sales for human consumption or possession with the intent to ingest could be prosecuted under the Federal Analogue Act though we are unaware of any such existing cases (11/16/11).
According to one news report, a DEA spokesperson has stated that it is a felony to purchase 4-MeO-PCP. See http://m.startribune.com/news/?id=129189483. Generally, the DEA considers any recreational drug that remotely resembles the chemical structure of a Schedule I or II substance to be a controlled substance Analogue if it is intended for human consumption.
