Methylone is unscheduled in the United States. It is possible that it could be considered an analog (of MDMA), in which case, sales for human consumption or possession with the intent to ingest could be prosecuted under the Federal Analogue Act though we are unaware of any such existing cases (6/21/04).
INTERNATIONAL LAW #
Denmark #
As of Feb 8, 2008, methylone is illegal in Denmark except for scientific and medicinal uses - see ELDD notice (English), KRIMI article (Danish). (thanks M, MX, S)
Netherlands #
Methylone was available in smartshops until early April, 2005, when Public Health Minister Hoogervorst stated that his department considered it illegal. See Explosion Brand Methylone.
U.K. (Britain) #
Methylone may be considered illegal under the Misuse of Phenethylamines Law (see UK Drug Law : Phenethylamines). This law includes a broad clause that prohibits structural derivatives of N-alkyl-alpha-methylphenethylamine (see text of law), and methylone may technically qualify. While methylone does contain a phenethylamine backbone, it is not clear whether its designation as a "structural derivative" would hold up in court.
In August 2008 a reader told us that they spoke to the Home Office by telephone. The reader reports being told that there are no restrictions on methylone, that it can be openly sold in the UK as long as a 'not for consumption' label is attached, and there are no plans to change any phenethylamine restrictions in the next twelve months.
